SACAT explained: what it is and when you'll deal with it

SACAT is the South Australian Civil and Administrative Tribunal – the body that hears applications for administration orders (financial), guardianship orders (lifestyle and medical), and a range of other administrative matters. Estate planning families typically encounter SACAT when an EPA or ACD is missing and a person has lost capacity.
What SACAT does in estate matters
Hears applications for administration orders (giving someone authority over finances when no EPA exists). Hears applications for guardianship orders (giving someone authority over lifestyle and medical decisions). Reviews and varies existing orders. Hears appeals from administrative decisions.
When you’d apply
A family member has lost capacity and there’s no EPA or ACD. An existing EPA holder is mismanaging the affected person’s affairs. A dispute exists about who should manage care or finances. The Public Advocate has been appointed by default and family wants to take over.
How long it takes
Routine applications: 6-12 weeks from filing to decision. Contested matters: months. Urgent applications can be expedited but still take weeks. This is meaningfully slower and more expensive than having an EPA in place.
What it costs
SACAT filing fees plus legal fees if you engage a solicitor. Total cost typically several thousand dollars. Compare to a few hundred dollars for an EPA executed while the person had capacity.
Why prevention is so much better
An EPA + ACD costs little and avoids SACAT entirely. A SACAT order requires a vulnerable family to navigate a tribunal during a difficult period. The case for proactive estate planning isn’t really about money – it’s about not having to deal with SACAT at all.
